Scottish Government issues buying and selling guidance during lockdown

The guidance stresses transactions may continue and it echoes guidance from the UK Government that all parties should seek to delay a house move wherever possible whilst the stay-at-home measures are in place.

If the parties are unable to reach an agreement to delay, people must follow advice on social distancing to minimise the risk of spreading the virus as a result of the move.

People who must move may proceed if it can be completed safely, with all parties maintaining social distancing requirements and if the property is empty or can be safely vacated.

If a move date has not yet been agreed, then one should not be agreed if it falls within the period during which stay-at-home measures apply.

Estate agents

While continuing to support their clients, estate agents need to take into account the latest guidance and can continue to advertise properties for sale but not allow viewings, conducting virtual viewings instead.

Decontamination

If it is known or suspected that previous occupants or someone they have been in contact with have Coronavirus it is advised a deep clean should be undertaken. 

Solicitors

Solicitors should make sure their clients are aware of the difficulties of completing transactions in this period, particularly where any documentation requires to be physically signed (and/or witnessed), including dispositions and standard securities. 

Surveyors

Surveyors may continue to support sales processes if they fully adhere to social distancing guidelines.

Housebuilders

Housebuilders can continue to take online reservations during this period and can work with their customers to line up sales for completion in the future.

Removal firms

Removers can honour their existing commitments where the move can be done safely and it is clear that the moving date cannot be moved, following the social distancing and hygiene guidelines, including maintaining a two-metre distance from others, and washing hands with soap and water often for at least 20 seconds (or using hand sanitiser gel if soap and water are not available).

In all sectors, no work should be carried out by a person who has coronavirus (COVID-19) symptoms, however mild.
